Terms of Service

These terms govern your use of Polymer's job board and applicant tracking software located at polymer.co and app.polymer.co. Curious One, Inc. operates Polymer. You may access and use Polymer only under these terms.

Important Terms

These terms include important provisions that affect your rights and responsibilities, such as limitations on Polymer's liability in “Limits on Liability”, your indemnification obligations in “Indemnity”, and an agreement to resolve disputes through arbitration in “Disputes”.

Legal Agreement

You may only access or use Polymer by agreeing to these terms. By creating an account or using our services, you show your agreement with these terms. The agreement between you and Polymer is a legally binding contract (Agreement). If you're using Polymer on behalf of an organization, you're agreeing to these terms for that organization.

Changes

We may update these terms from time to time. We'll notify you of significant changes through the email address associated with your account or by posting a notice in the application. Your continued use of Polymer after changes are posted constitutes your acceptance. We may also modify or discontinue features of Polymer at any time.

Privacy

We respect your privacy and limit use and sharing of information collected through Polymer. Our privacy policy at polymer.co/privacy describes these practices. We'll abide by that privacy policy and honor your privacy settings.

Data Security Policy

Polymer is committed to protecting the security and privacy of your data. We implement industry-standard data protection measures to safeguard your information against unauthorized access, alteration, and misuse. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. It is your responsibility to notify us immediately if you believe the security of your account has been compromised.

Your Account

You must create an account to use Polymer. When creating an account, you must provide accurate information including a valid email address. You must be at least 18 years old. You're responsible for keeping your password secure and for all activity under your account. Notify us immediately at support@polymer.co if you suspect unauthorized access. You may not impersonate others or create misleading accounts. We may suspend or terminate accounts that violate these terms.

Service Plans

Some features of Polymer are only available under particular Service Plans. When you create your account, you begin on a free-of-charge Service Plan. You may change your Service Plan at any time through your account settings. Current plan details and pricing are available at polymer.co/pricing. By selecting a paid Service Plan, you agree to pay the fee shown for that Service Plan when you select it.

Permitted Uses

Your permission to use Polymer allows you to use the service for its intended business purposes, including posting job openings, managing applicants, and collaborating with your team on hiring decisions. You may access all features included in your selected Service Plan and export your data as needed.

Conditions

Your permission to use Polymer is subject to the following:

  1. You must be at least 18 years of age to use Polymer
  2. You may not use Polymer after we say you may not, such as by disabling your account
  3. You must use Polymer in accordance with “Acceptable Use”

Acceptable Use

You must use Polymer only for lawful purposes and in accordance with these terms. You agree not to use the service in any way that could damage, disable, overburden, or impair it, or interfere with any other party's use of the service. This includes, but is not limited to, submitting or transmitting content that may be deemed illegal, offensive, or harmful, posting fake, fraudulent, misleading, or discriminatory job listings, impersonating companies or organizations, misusing candidate data, violating any laws, or unauthorized access to accounts. Additionally, you may not use fake job listings to collect candidate information, use automated tools that could impair our service, or use candidate data for non-hiring purposes such as selling contact lists or unsolicited marketing. Polymer reserves the right, at its sole discretion, to review account activity for compliance with these policies and take appropriate action, including limitation, suspension, or termination of service, to maintain service quality and protect all users.

Enforcement of Acceptable Use

Polymer may investigate and prosecute violations of these terms to the fullest legal extent. Polymer may notify and cooperate with law enforcement authorities in prosecuting violations of these terms.

Your Content

Nothing in these terms gives Polymer any ownership rights in intellectual property that you share with Polymer, such as your account information or branding. This intellectual property is Your IP. Nothing in these terms gives you any ownership rights in Polymer intellectual property provided via Polymer, like software, documentation, templates, trademarks, service marks, logotypes, or other distinguishing graphics. Between you and Polymer, you remain solely responsible for Your IP. You will not wrongly imply that Your IP is sponsored or approved by Polymer. Polymer will not be obligated to store, maintain, or provide copies of Your IP, except per the privacy policy. You grant Polymer a limited license to Your IP solely for the purpose of providing the services as you instruct. When posting jobs, you represent that they're legitimate positions and that you have authority to post them. You're responsible for compliance with employment laws and data protection regulations.

Candidate Information

You acknowledge that you're the data controller for candidate personal information collected through Polymer, and we're the data processor. You're responsible for handling candidate data in compliance with applicable privacy laws. Candidates who submit applications through Polymer consent to their information being used for evaluating their application and potentially for future job opportunities. You should not use candidate data for unrelated purposes without additional consent. You're responsible for the security of any candidate data once exported from Polymer or sent to third-party applications. You should only access and use candidate information for legitimate hiring purposes.

Payment Terms

Certain features of Polymer are only available under paid Service Plans. When you select a paid Service Plan, these payment terms apply. When enabling a paid Service Plan, you must provide all the payment card details requested by Polymer. Those details must be for a valid payment card that you have the right to use. You must keep your payment details up-to-date via your account settings. Upon selecting a paid Service Plan, Polymer will immediately charge your payment card the amount for the Service Plan. All paid subscriptions automatically renew until you cancel them. Polymer offers both monthly and annual billing options. Monthly plans are charged at the end of each month-long period. Annual plans are charged at the end of each year-long period and may include discounted pricing. You can change your Service Plan at any time via your account settings. You may request a refund within 7 days of any charge for Polymer subscription plans by contacting support@polymer.co. Refunds are not available for third-party listing services or after the 7-day window. You can downgrade to our free plan anytime to stop future charges while keeping your data. For billing errors or unauthorized charges, contact us within 30 days. Unless these terms or Polymer specifically say otherwise, all Dollar amounts are amounts of United States Dollars. You must pay for paid Service Plans in United States Dollars. They do not include tax. You will pay any tax.

Cancellation and Termination

Either you or Polymer may terminate this Agreement at any time. You may downgrade to our free Service Plan at any time through your account settings. This stops billing at the end of your current billing period while maintaining access with free plan limitations. To completely cancel and delete your account, contact us at support@polymer.co. We may suspend or terminate accounts that violate these terms, engage in illegal activities, or fail to pay fees. Upon termination, you lose access to paid features. We may delete your data after a reasonable retention period. Provisions regarding intellectual property, indemnification, disclaimers, and limitation of liability survive termination.

Third-Party Services

Polymer integrates with third-party services like Google Jobs, LinkedIn, Slack, Discord, Zapier, and others. We're not responsible for these services or their content. Your use of third-party services is governed by their terms. Integration availability may change without notice.

Intellectual Property

Polymer's software, design, content, and trademarks are our property and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials. Nothing in these terms grants you ownership of our intellectual property. Feedback and suggestions you provide become our property and may be used without compensation.

Indemnity

You'll indemnify and hold harmless Polymer, its officers, directors, employees, and agents from all claims, damages, losses, and expenses (including legal fees) arising from your use of Polymer, Your IP, your violation of these terms, or your violation of others' rights. You won't settle any proceeding without our prior written consent. We'll notify you of any proceedings we become aware of.

Disclaimers

Polymer is provided “as is” and “as available” without warranties of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that Polymer will meet your requirements, be uninterrupted, secure, or error-free. We don't guarantee any particular results from using Polymer. You use Polymer at your sole risk.

Limits on Liability

To the maximum extent permitted by law, Polymer won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use. Our total liability for any claims won't exceed the amount you paid us in the twelve months before the claim arose. If you're on our free plan, our maximum liability is $100. These limitations apply regardless of the legal theory and even if we knew of the possibility of such damages.

Disputes

Delaware law governs these terms and any disputes. We'll first try to resolve disputes informally. Contact us at support@polymer.co to start this process. If we can't resolve disputes informally, you and Polymer agree to binding individual arbitration under the American Arbitration Association rules. Arbitration will occur in Delaware. You waive any right to participate in class actions. No arbitrator may consolidate proceedings without our permission. You may opt out of this arbitration agreement by sending written notice to support@polymer.co within 30 days of first accepting these terms. Your opt-out notice must include your name, email address, and a statement that you wish to opt out of the arbitration clause. Either party may seek injunctive relief in court. The prevailing party may recover costs and reasonable attorney fees.

General Terms

If any provision is unenforceable, it will be modified to the minimum extent necessary or removed. The remaining terms continue in effect. You may not transfer your account without our written consent. We may assign these terms in connection with a merger, acquisition, or sale of assets. No waiver of any term is a waiver of any other term. These terms and our privacy policy constitute the entire agreement between us. They supersede all prior agreements.

Climate Commitment

We contribute 1% of every payment to remove CO₂ from the atmosphere through Stripe Climate. Learn more at climate.stripe.com.
